Hi, I wanted to know from an employee perspective.
Currently I am working as Software engineer in an MNC, recently I resigned my current organisation after receiving a "letter of Appointment" from an another MNC.
I sent a mail to my future employer HR, mentioning that I am accepting this offer and I will be joining on so on so date. In return also I got confirmation from their side.
So my question is "Is there any chance, that my future employer reject given offer..??" If rejected, is there any possibility that I can take any Legal action against employer.

Hi Sagar,
It is my personal view.
Ideally it should not happen but Sometimes it may happen that your future employee may put the position on hold for any reason OR may be they do not need your services OR they may found someone who is ready to join the same profile at a lesser salary etc... etc... etc...

It may happen and you will not have any legal case to make, as you will not have been given the appointment letter. I am saying this as a lay man. Also, they could take you on and make the position redundant when you are still on probation. However, these do not happen on a large scale.

Dear Sagar,
1) Unless and until you get a offer letter on letter head of new company you cannot consider that you have been offered a job.
2) If you have received above letter from the company than yes you can take a legal action against them if not forget the company and look for other option.
Any other communication is null and void and this will not stand in court of law.

As rightly said by Simhan, even if you take any legal step, they will hire you for a month or two and fire you without any notice, as you will be in probation.

In any company,recruitment is done on the basis of the manpower requirement.If you have been selected for a particular post in any company and they have issued an offer letter to you ,then ethically they can not reject the offer ,they had offered you.
And if they do you have the right to take legal action against them ,on the basis of the offer letter which they have issued .

Dear Sagar.
What ever the expert giving their opinion , is true. however try to find out on what ground they are rejecting your employment. may be they must have checked your credential with previous employer or they must have got some adverse information about you , on that ground they can refuse your appointment , however they have to give you ieither in writing or verbally they have to convey .
Other wise also you can not take any legal action against them. they can given any dam reason. so best way look for another opportunity. you being technical qualified person will definitely get the job else wear

In my view, Legally there is no scope to fight against the company. It depends upon the term and conditions of the company while issuing appointment letter. And another important thing is that probationary period. During this period the company may terminate any employee, which is accepted by the employee at the time of joining into the company.

Dear Sagar,
It happens sometime due to various reasons, just take a look of your appointment letter which is issued to you and you had accepted. if it is on letter head then you can go in legal way or you can take a chance on behalf of mail communication which is done by HR from co. official email id. but you wouldn't get anything, co. will feel guilty and they will hire you and as all Sr. telling you that in probation period co. can fire any employee so they will do it later and then you will be helpless. so better is if you have any doubt then start searching alternate option.
