For your information, reference, and records, there has been another landmark verdict given by the EPF Appellate Tribunal in Indore regarding the splitting of Minimum Wages for PF Contribution, which has been a subject of dispute.

A good piece of information but its not the latest. This was on 2/9/11. The latest in this context is the circular date 27/9/11 which has kept the circular dated 23/5/11 in abeyance.

Unfortunately, the EPF authorities are not following the decision of the Appellate Tribunal and refer only to the Hon'ble High Court decision in Sec 7 A enquiry. They do not refer to or rely on their own Appellate Tribunal decisions even if they are favorable to the Employers, like the Indore decision referred to by Mr. Sundararaman. This can be rectified only by directions from the Ministry of Labour and Employment, Government of India, as well as the Central Provident Fund Commissioner, New Delhi.

You can file a legal case against the PF Authority because the circular dated 27/9/11 clearly stated, "The circular dated 23/5/11 regarding the splitting of Minimum Wages for EPF is in abeyance." Everyone has to wait until further notification comes. No department is above the law.

The referred circular from the PF Department itself is enclosed for ready reference in case anyone does not have a copy of the same. It has been clearly mentioned that their circular dated 23rd May 2011 is kept in abeyance.
