Hi everyone, first of all, good morning to everyone and wishing you all a happy festival season coming in the next 30 days or so. I am in a bit of a dilemma, please guide me. I need to appoint a supervisor for the construction of our new building, where our existing factory will be relocated. I am looking for only one supervisor, and my payment limit is only Rs. 10,000 per month. Unfortunately, no one is willing to work at this rate, as after deductions of P.F. & E.S.I., the amount reduces even further. This is a 12-hour, 31-day job per month for the entire project, practically meaning no holidays.

Alternative Appointment Methods

Is there any alternative way to appoint a person for this work as per existing laws without the mentioned deductions? Can I appoint him as a contractor for this job so that he can work independently and submit his monthly bill of Rs. 10,000, or as the case may be? If so, is it compulsory for him to obtain a license for working on a contract, even if he has not practically engaged any labor and is supervising himself? If this method is adopted, will it be a legal or right practice?

Please provide your opinions and valuable advice.

Dear Pon,

Thanks for your advice; I also considered appointing him as a consultant. However, in that case, the TDS calculated is at 10% of the billing amount. This means a deduction of Rs. 1000, which would benefit neither the company nor the appointee. Is there any other option?
