Dear All,
Please guide me on the issue of whether a Real Estate Organization dealing with the development of residential and commercial buildings will be covered by the ESI Act. I just checked the bare act where nothing is specified about a real estate organization. Please provide the relevant section or case if any.
Regards,
DG

The state government is empowered to cover establishments, whether commercial, industrial, etc. Your business activity seems to be covered under the commercial establishment. You must have registered your business under the Shops & Establishment Act, 1948. Hence, the ESIC will become applicable to your business. You may refer to section 1(5) of the ESIC Act.
