I am working as an HR Assistant. I need the PF procedure for a rejoining staff member. Two months ago, one staff member resigned, but on 3-Mar-11, he rejoined our company. I need the PF procedure for him. Should he fill out Form-2 or not? Will he transfer his PF amount to another PF number? Please provide me with the solution.

Options for PF Number Management
You can follow any of the following options:
- You can retain the same number if you have not sent the required details to the PF office.
- You can provide a new number and instruct the employee to initiate the transfer of the PF amount.

Since the employee left 2 months ago, the intimation of the departed employees must have been given by you to the PF office. Now that he has rejoined, he will be treated as a new employee.
Please ensure the necessary PF forms are filled out by him as you would for a new employee. A new PF account will be opened, and then transfer the PF funds from his previous service to the new account by completing Form 13 (transfer form).

Thank you for your valuable comments. I have a question regarding a new staff member joining. If an old staff member left and then rejoined the company after a few months, what about his gratuity? What about his bonus? In my current company, I issued a transfer letter to our associate company. The staff member resigned from the associate company and rejoined our company after four months. We have submitted Form 5 and Form 10. Now, the staff member is asking about his gratuity terms and bonus terms. Please update regarding this issue as soon as possible.

Considerations for Continuing the Old PF Number
1. If you continue the old PF number, it means he will have continued service in your organization. This continuation will be expensive when he retires in the calculation of GRATUITY.
2. If you continue the old PF number, what about the last three months of PF contributions?

If you have received a resignation letter from the same employee and all the details have been submitted to the PF office as we usually do on a monthly basis for compliance, by depositing the monthly returns with Form-5 & 10. Hence, treat him as a new employee, but this will result in the loss of other benefits like gratuity, etc. I will assist you in case the details have not been provided to the PF authorities; in that scenario, consider him as an old employee with the same PF numbers and joining details. Regarding the gap between the resignation and rejoining, mark it as "LWP" (leave without pay).
