Employees are entitled to 5 days of leave for every 60 days worked if the employment duration is more than 3 months. Alternatively, if an employee has worked for not less than 240 days in a year, they are entitled to 21 days of leave. The accumulated leave can go up to 42 days, and wages should be paid for any leave not taken when the employee leaves the company. Please note that intervening weekly holidays will be considered as part of the leave entitlement.
Based on this calculation, employees are eligible for 30 days of leave in a year if they have worked the entire year. Could you please provide clarification on this policy?

Could you please shed some light on the following?
1. As per the TN S&E Act, I understand the leave entitlement to be 12 CL / 12 SL / 12 EL, whereas you mention 21 days EL. I agree with the point of 1 day for every 20 days worked.
2. Is it mandatory to encash the EL leave?
I would appreciate it if you could provide your comments/views on the above.

T Sampath

I'm currently working for a group of companies involved in book publishing and sales of books and notebooks. Could you please provide information on which leaves are applicable for this establishment? Also, is it necessary to pay sick leave for shops and establishments in Tamil Nadu that are covered?
Thank you.
