Dear all,

Can anyone help and give me a solution for the following question:

Our company is paying a Medical allowance to employees, which is factored into CTC itself, amounting to Rs. 15,000/- per annum. I have instructed my colleagues to produce bills worth Rs. 15,000 to claim exemption. My colleague has presented the bill accordingly, which includes bills for her father, mother, and brother. She is unmarried, and the point is her father is a Doctor. He is also filing the return of income and claiming for exemption. Her daughter, who is working in our company, also claims bills related to her father.

My question is whether she can claim her father's bills too. Only the dependent bills and herself can claim. In this case, she is unmarried, and her father is also working. In that case, how can she claim her father's bills?

Kindly explain and provide a suitable section to justify/substantiate my answer, please.

Thanks,
Sreedar.

Dear Sreedar Srinivasan,

She can claim bills related to her father as well, but ensure to obtain the original bills from her and file them. This is important because there is a chance that both she and her father may claim the same bills with the IT department. Such actions are against the law and are punishable.

Thank you.

Hi,

Thank you for your reply. I received the bills in original and was also informed that the bills do not overlap with what she claims with her father in his income tax return. Could you kindly send any notification to substantiate this, please?

Once again, thank you for your quick and appreciated reply.
