Dear All,

I am in a telecom-based organization where the employee strength is more than 40, and it is a newly established company. My directors are not included in the employee list. Today, my director told me, "Please include me in the employees list." Is it possible or not? If possible, then how? If not, then why?

Remember, I have already submitted PF contributions of my employees, excluding the directors' names, and this is a two-month-old private limited company.

Please guide me on what I can do for the same.

Generally, as per the Companies Act, a mere Director is not an employee of the Company. However, if they are a managing director or executive director, or if they are receiving a salary for the rendering of services, then they are considered an employee of the Company.
