Dear Seniors,
Is paying of PF/ESIC compulsory for Employer (proprietor) If the establishment has about 14 employees on rolls and about 17 employees on Fixed Term Contract basis. Please guide.

Well . its a good question.
Let us introduce ourselves. We are an educational institution based at Kolkata providing guidance on LAW and PHYSICS.
We also provide free advice to the students, general public and people like you.
Under the PF Act proprietor is not deferrent from employer.
Please let me know the total contractual period of these 17 employees first.
Also let me know the minimum basic salary of the 14 employees.

Hi Sura,
For any oraganization 20 or more employees will Applicable for PF & ESI.
wages upto 6500 @ 12% of Basic+DA PF IS MAndatory
if the employee is drawing gross salary <=10,000 he/she will eligible for ESI.

For the 17 employees its a Fixed Term Contract for 1year (mentioned in the appointment letter itself) & the salary range is from 4500 to 9000...regarding the rest 14 i guess since their range is above 10k basic so it should not matter

Thank you Sir for the inputs.....As I understand PF is mandatory if employee numbers are 20 or more, irrespective of whether if they are in Contract, FTC (Fixed Term Contract) or employees. So therefore depending on the salaries PF & ESIC comes into force.

Dear,
There is a clause in PF act. It says that (under sec 56b) act is not applicable to any other establishment newly set up until the expiry of a period of three years form the date on which such establishment is, or has been, set up.

According to rule if basic is more than 6500 than PF is not compulsary and the ceiling gross salary for ESI is 10,000
