Please tell me when to deduct the Labour Welfare Fund and how to pay in Chennai. Is it payable only after obtaining the Labour license? Expecting your kind help immediately.

Dear Mr. Prabhakar,

You need to deduct Rs. 7/- from the employees on the roll and Rs. 14/- to be made as management contribution in December month's salary. You can pay the amount on or before the 31st of January 2010.

Dear Mr. Prabha,

Here are some points that answer the frequent doubts arising in members like you.

You can cover LWF up to the grade of Managers. All Directors and Authorized signatories (who have the right to punish employees) and Internal Consultants are exempted from LWF.

The LWF is deducted and remitted annually in December at Teynampet. Once becoming a subscriber of LWF, a Tamil monthly 'Uzhaippavar Ulagam' is sent to you. This carries the latest amendments, Trade Union laws, judgments related to Labour Act, etc.

LWF has no relevance to PF/ESI coverage in general. Those exempt under ESI will also be covered under LWF.

Fill up Form-A, mention the company name (without any LF code No), address, list of employees, fund particulars, and remit for the first time by chq/DD. A new LF No will be allotted later in the receipt.

Forward a copy of this receipt and annexure particulars to the Finance Department of your company.

Dear Prabha,

LWF Contributions from the Employees for the year 2009 and the details are as follows:

1. Employee Contributions of Rs. 7.00 per employee.
2. Employer Contributions of Rs. 14.00 per employer.
3. Cheque should be made payable to "The Secretary, Tamil Nadu Labour Welfare Board," payable at Chennai.
4. Please enclose a statement in Form A duly filled in.
5. The last date for submitting the above with a covering letter is 31st January 2010.
6. There is no need for any license to make payments to LWF.

For calculating E.L (for the year 2010), what components should be considered? (e.g., absent, C.L, E.L). Also, what is the meaning of the number of days working [(365 days - 52 Sundays - N.F.H)]? Is this correct? Kindly guide me.

I have not paid the contributions of a few employees who had joined in Dec 2008. By mistake, I didn't make their contributions. Can anyone suggest a solution? Can I pay the last contributions with the current return of contribution?

Dear Rahul,

You have to deduct Rs. 6 for a gross salary below Rs. 3000 and Rs. 12 for a gross salary above Rs. 3000 as employee contribution. The employer's contribution is three times the employee's contribution. This deduction is made from the salary in June and December. The return should be submitted in Form A1 before the 15th of the following month.

Dear friends,

The LWF must be deducted from every December salary. It should be sent with a DD, cover letter, Form A, Form B, and Form C to the Secretary of the Tamil Nadu Labour Welfare Board by January 31.

Send it now. Go through your State Labour Welfare Fund Act for the interest clause, and if there is an interest clause, then also pay the interest along with this delayed deposit of the contribution of Dec. 2008.

Dear Chandu,

For EL, you have to consider the calendar year, i.e., Jan-Dec for leave calculation. Paid days need to be taken into account for EL calculation, like (No. of EL's / No. of working days * No. of paid days). For example, (Last Increment basic + Last increment VDA) / 30 * No. of EL's.

Dear T Prabhakar,

The Labour Welfare fund in Tamil Nadu (not only Chennai) is deposited annually, with the last date for deposit being the 31st of January each year to the TAMIL NADU LABOUR WELFARE COMMISSIONER. The worker's contribution is Rs. 5 per 12 months, while the employer's contribution is Rs. 10 per 12 months.

In Mumbai, the details for Labour Welfare Fund payment are as follows:

1) If the salary is up to Rs. 3000, the employee contribution is Rs. 6 and the employer contribution is Rs. 18.
2) If the salary is more than Rs. 3000, the employee contribution is Rs. 12 and the employer contribution is Rs. 36.

Payment Mode: Half-Yearly (June & December)

- Rs.7/- will be deducted from the workmen's salary in the month of December, and Rs.14/- will be contributed by Management for each employee.
- The payments should be made before 31st January.
- A DD or Cheque in favor of The Secretary, Tamil Nadu Labour Welfare Board should be raised.
- This is not connected with PF or ESI. However, you must mention the LWF payment details during Factory License Renewal time.
- Form-A should be supported with a Cheque.

As per Section 10 of the A.P. Labour Welfare Fund Act, every employee shall contribute Rs. 2/- per year to the fund, and every employer shall, in respect of each such employee, contribute Rs. 5/- per year to the fund. These contributions shall be remitted before 31st January every year. We are to deduct in December wages and to be deposited with the Welfare Commissioner, AP Labour Welfare Board by DD or Cheque. Dear Friend,

The Labour Welfare Fund has to be deducted twice in a year, i.e., from the salary of the months of June and December, and it has to be deposited in favor of the "Maharashtra Labour Welfare Fund" in the succeeding month. The ratio is 1:3. If an employee is drawing a gross salary of Rs. 3500 and below, they will have to contribute Rs. 6, and the employer's contribution will be Rs. 18. For those employees drawing a gross salary above Rs. 3500, the contribution will be Rs. 12, and the employer's contribution remains Rs. 18. The amount of contribution shall be paid through a challan in Form-A1.
