Can We Start Operations with Just a Factory Licence Receipt? Seeking Guidance

Hi all,

We have applied for a Factory Licence, and we have paid the fees. Additionally, our factory plan has been approved by the Factory Inspector. We have an application receipt provided by the Government authority for the same. So, my question is, can we start our factory without the Factory Licence, even though we have the fees receipt?

Kindly guide me on what steps to take.

If an application for the factory license has been made and there has been no reply from the concerned authority within 90 days, then presume that the said application has been deemed approved.

Normally, acquiring a factory license takes some time, and you cannot wait until then. Once the factory drawings are approved by the Factory Inspectorate Office and the construction is progressing accordingly, there should be no issue moving forward.

Once you applied for the plan approval and license and obtain the acknowledgment, it is legalized. So, you need not wait for any approval, and you can start the production without any delay.

This information is all good. However, can someone please help me determine under which circumstances you have to apply for a factory license? We are a trading firm with a business premise in Mumbai, located in an Industrial Estate. We have a storage license for the goods we trade. Additionally, we have a small chemical testing laboratory on our premises to ensure the quality of goods supplied by our vendors. This laboratory is solely for our own use and is equipped with a stirrer, weighing scale, oven, and dyepot.

Now, the Mumbai Municipal Corporation is requesting a factory license from us. Is it mandatory to apply for a factory license even if our business nature involves trading with our own testing facility? Your guidance on this matter would be greatly appreciated. Thank you.

Response Time for Factory License

Can anyone please let me know what the response time is from the factory inspector to obtain the license? If they do not respond or return the license copy, what can we do? Can we stop production and wait for their response?
