Hi Octavius,

This post is indeed very helpful. Could you please help me with one more thing: Is ESIC applicable to the BPO industry?

Awaiting your guidance.

To calculate the gratuity for a company with 250 employees and the submission of annual returns, you would typically follow these steps:

1. Determine the total number of years each employee has been in service.
2. Calculate the basic salary of each employee.
3. Use the gratuity formula applicable in your region to compute the gratuity amount for each employee based on their years of service and basic salary.
4. Sum up the individual gratuity amounts to find the total gratuity liability for the company.
5. Ensure compliance with relevant labor laws and regulations regarding gratuity payments and annual return submissions.

If you need further assistance or specific guidance based on the location of your company, feel free to provide additional details for a more tailored response.

Hi Buddy,

What an effort you have put in! You must have saved a lot of time for others. Hats off to you. Cheers!!

Can you please help me understand Fixed Term Employment/Hire and how similar it is to permanent hire and different from Contractual Labor? Is it covered under any existing laws? Do we have any laws guiding its compensation and leave process?

What checklist does one need to take care of to ensure that everything complies with Indian laws?

Your assistance in this matter would be highly appreciated.

Thanks, Buddy,
Vin Roy

If you update Labour laws with those recent changes, that would be great.

Respected Octavious, I have gone through your attachment on labor law, and I found the ESIC ceiling to be ₹10,000 and gratuity at ₹3.5 lakhs. There have been no changes. Please update us.

Thank you.
K.SYadav
Please note that the wage ceiling is ₹15,000 under ESIC. Gratuity payment is now up to ₹100,000, depending upon the period of service and salary.

I just came to know that PF rules have changed, and now three parameters have been added: employee, employer, and bonus. Is it true? Kindly let me know as I don't have much idea.

Thanks & Regards,

Hi, very good information. I am a student who completed an MBA with an HR specialization and am looking for a career in HR. I am requesting all HR professionals, trainers, and forums to provide me with details of labor laws and statutory compliances followed by HR in IT/Non-IT organizations. This will help me gain knowledge and prepare for interviews to seize opportunities.

I appreciate the efforts taken for posting the above-attached files. However, I have a humble request. When we professionals post something, it should be authentic. I think the writer has not updated their knowledge. The latest amendments and notifications are not included, which could misguide the readers. I have gone through the post at a glance and found two mistakes.

Mistakes Identified

One is the name of the Workmen's Compensation Act, which has been changed to the Employees' Compensation Act. The second is the upper limit of the Gratuity amount as per the Gratuity Act, which has been enhanced from Rs. 3.5 lakhs to Rs. 10 lakhs. I request the author to review the article fully and incorporate the latest amendments and notifications.

C. K. Krishnan.

Hi Octavious,

This is very useful, but can I know until what date it is updated? I am currently researching the same to incorporate it into my organization and to enhance my knowledge in this area. Please inform me if this information is up to date.

Thank you.

Dear HR people, I have completed 2 years of agreement in my present organization, and I was relieved on 28 Feb 2017 along with experience and relieving letters. However, that organization still hasn't paid my ELs and gratuity. When I call the HR, they respond with "we will give next month" or "we are working on it" or "head office people are not responding."

They have deducted gratuity from my salary every month, and I know they haven't prepared HR policies. According to labor laws, how many days will it take to settle the final payment to a resigned employee? Is there any other way to get my amount?
