Should We Issue a Transfer Letter for Trainees on Contract? Seeking Advice

Hi All,

I have a query. We have trainees on contract, and they are not on the rolls of the company. The contract clearly mentions that the trainee would be transferred anywhere in India or outside. My query is, "If the trainee is transferred from the base location to another branch office, should we issue him a transfer letter or any letter for that matter?"

Please remember, in case of a transfer of an employee to another location, he will be eligible for allowances as applicable to the outside location.

As you know, his salary or stipend was negotiated for the current location based on certain facts and circumstances which have changed as a result of the change in facts and circumstances; his stipend amount will also change.

I strongly believe that the employer is taking advantage of his contract terms to transfer, but this is subject to certain compensation elements on account of the transfer; otherwise, this transfer will be null and void under labor laws.
