Holiday and Leave Overlap: Does a Holiday Count as Part of Your Leave Days?

madhumitaparija
Hi,

Can anyone please tell me if a holiday precedes or follows leaves, would that holiday be counted as part of the leaves? What if a holiday comes in between two leaves?

Thanks,
Madhumita

Dear Madhumita,

When a holiday precedes or follows leaves, it won't be counted as part of the leave. However, if a holiday falls in between two leaves, it will be considered as part of the leave days.

Dear Member,

It depends on the type of leave. There are three types of leaves that a company gives to their employees: CL, SL, and PL. If anybody is availing PL, then certainly the holiday will also be included. However, if it is a CL/SL, then the holiday will not count.

Dear Sirs/Madams,

Is it compulsory that the MINIMUM EARNED LEAVE SHOULD BE 4 DAYS?

I'm sorry for differing with the above views.

This is the normal practice for following leave rules:

1. CL - A casual leave can only be prefixed or suffixed with a holiday, but not both. Hence, the holidays during the leaves shall be counted as such leave. The same case applies to Sick leave. The holidays during sick leave are counted. In other words, can you agree that a person is not well on Saturday and on Monday but perfectly alright on Sunday, which is a holiday?

2. As far as PL is concerned, as per the factory laws, the holidays that occurred during PL cannot be counted. This leave is earned by the employee for working in the previous calendar year. Hope this is clear.

CL can be either prefixed or suffixed to a holiday and not both. Holidays falling amidst SL are counted as SL.

For PL or EL, it depends:

1. If the company provides PL (rather than EL) on actual days worked in the previous year, then holidays falling in between PL cannot be counted, i.e., Satri has mentioned referring to the Factories Act.

2. Companies that have a PL policy which is not calculated on actual days worked but on an annual basis (like 30 days PL or 2.5 days/month), in that case, the holidays falling in between are counted as PL availed. (It is the case where white collars are being paid for their weekly offs, which they have deemed worked on that day.)
