Understanding PF Payment Deadlines: How Does Your Salary Date Affect It?

sudha5555
Hello,

What is the last date for PF payment? Does it depend on salary data? For example, if the salary is paid on the 10th of every month, then what is the due date for PF payment? Could you please provide details?

If the wage month is January 2008, the EPF of that month (called wage month) shall be paid on or before the 15th of February 2008. However, no penalty is imposed if the same is paid within the 20th (i.e., 5 days are given as grace period). However, if you fail to pay it on the 20th, then penalties, damages, etc., will be calculated from the 16th day of the return month.

For ESI, the last date for payment of contributions pertaining to a wage month is the 21st of the succeeding month.

What is the penalty percentage and how is it calculated?

Salary paid date is irrelevant when calculating the PF due date.

Hi Sudha,

The last date for the P.F. contributions Payments (for every month) is the 15th of the preceding month. The 26th of every month is the due date for the submission of Returns along with Payment Challan. This deadline is not dependent on the individual company's payment period. It is as per the statutory regulations mentioned above.

1) Is it the 26th or the 20th? Along with the payment, we only submit PF challans, which is due on the 20th (inclusive of the grace period).

2) Please refer to the content in the top right corner of the 3rd page of this PDF: ww.icai.org/icairoot/publications/complimentary/cajournal_oct03/p423-426.pdf. I still have doubts regarding the due date calculation.

The date of disbursement of salary is irrelevant for this, and the due date for payment of employees' and employer's contributions, along with administrative charges, is the 15th of the next month following the month in which the salary is disbursed.

Hello everyone,

My query is in respect of Sec. 36(1)(5a) & Sec. 2(24) in respect of payment on account of P.F. & E.S.I. by the company delayed but paid before submission of I.T.R on the due date as prescribed under the Income Tax Act.

"Shall the late sum paid on account of E.S.I. & P.F. be allowed or not, if payment is made within the relevant financial year?"

Thank you.

The grace period of 5 days is over! Moreover, the word used is "payable" or "paid." Belated remittances do attract penalties.

Yes, I too remember reading that the grace period of 5 days has been withdrawn. Hence, now PF contributions along with other administrative charges have to be paid by or before the 15th of every month.

EPF Payment Deadline and Penalty Details

Since the payment of EPF online has been made mandatory with effect from the wage month of January 2016, the last date of payment is the 15th of the next month concerning the wage month. Could anybody please elaborate on the percentage of the penalty if paid after the due date and how it is calculated? For example, if an employer paid the EPF dues for August 2015 in December 2015, how much penalty would have to be paid? What are the provisions in the EPF rules if the penalty is not paid by the employer, and is there any loss to the employee if they quit the company between August 2015 and December 2015?

Thanks & regards
