Compensation for Deceased Employee's Family: What Are the Norms in Private Companies?

Hi,

Can anyone enlighten me on compensation payable to an employee's family who has deceased (natural death) while in service in a private company not involved in manufacturing?

Dear friend,

When it is a natural death, where is the question of compensation? Compensation is payable only if an employee dies in an accident in due course of employment. I assume all labor legislations are applicable to him. Then the legal heirs can get the following payments:

1. Gratuity
2. Accumulated PF
3. Pension for the family under the PF and Pension Act
4. An amount depending on his service and the accumulated PF, which is called Deposit Linked Insurance
5. Encashment of leave
6. If covered under ESI, Funeral Benefit

Dear Siva,

Thanks for the reply.

One point to note is the gratuity up to the age of retirement, i.e., 58. Additionally, there are funeral expenses reimbursement benefits available from the Labour Welfare Department. These benefits can be availed in Tamil Nadu.

I am sorry. Funeral expenses are available only for those who are covered under ESI and paid by the ESI Corporation.
