Is Our Company Required to Comply with the ESI Act Given Our Employee Salaries?

Dear Seniors,

In our company, there are 50 employees, out of which only 5 employees have gross salaries of less than Rs. 10,000. Is our organization applicable under the ESI act?

Dear All,

I want to provide clarification regarding the applicability of ESI to an establishment. In such a scenario, ESI is not applicable.

As far as PF is concerned, in that case, a PF number is necessary if all the employees of the establishment earn above the ceiling amount, i.e., Rs. 6,500/-.

Kindly correct me if I am wrong.

Applicability ESI comes only if your organization has 20/10 coverable employees, whose salary is Rs. 10,000 and below.

Dear Friend,

ESI is not applicable to your organization as per the new amendment, which states that for coverage purposes, we only need to calculate those employees who are earning less than Rs. 10,000.

My company is a consulting firm with 40 employees, and out of those 40, 35 are receiving a salary of more than $10,000. Are ESI or PF applicable to my company?

I am working in a Records Storage & Retrieval Management Company. This company is involved solely in the storage of hard copy records, utilizing 20 kilowatts of electricity for bulbs, tube lights, and office operations. Could you please advise if we can be covered under the ESI Act? We have received a notice from the concerned department and have been allocated a number. What steps should we take if we are not eligible for ESI? Your assistance in this matter would be greatly appreciated.
