Employer Withheld PF Contributions: What Steps Should I Take Next?

I was employed by Navrachana Higher Secondary School from June 1977. The school authority has suspended me pending an inquiry since March 2004. I have filed a case against the management at the Higher Secondary Tribunal in Gujarat State.

My employer has not deposited their PF contributions for the years 2005, 2006, and 2007. The employer served me a retirement letter on 13/5/2007 upon my attaining 58 years of age. The case is still pending in the tribunal. I have already complained about this to the regional PF office, but no action has been taken by the PF office.

What should be my course of action?

Take help from the media. Nowadays, they provide great exposure to issues of justice. Create an interesting case and reach out to them. Gain popularity and support. Many people may be affected by this issue, so gather them together. Unite one by one and fight for it.

Dear Mr. Bhat,

There are two issues:

1. Disciplinary proceedings and the case in court.
2. Retirement at the age of reaching 58 years.

There is a dispute on item 1. There cannot be any dispute on item 2. The dispute is in court. Ask your advocate to file a petition before the Honourable Presiding Officer seeking direction to PF Authorities to settle your PF claim and also your Pension immediately.

While doing so, plead that the Pension calculation must be made as though you are in service up to the age of reaching superannuation. You will get a direction in your favor.
