Opening a Branch Office in Delhi: Do We Need to Register Under the Shops and Establishment Act?

I have a query regarding the registration under the Shops and Establishment Act in Delhi. We are planning to open a branch office in Delhi. Do we need to register under the Shops and Establishment Act in Delhi? Additionally, could you please provide information on any other registrations required for opening a branch office in Delhi?

The objective of the Act is to regulate the working and employment conditions of workers employed in shops and establishments, including commercial establishments. The Act generally provides for the fixation of working hours, rest intervals, overtime, holidays, leave, termination of service, maintenance of shops and establishments, and other rights and obligations of the employers and employees.

The Act also provides for registration for shops and establishments. However, the requirement of registration has been kept in abeyance since 1989.

I would like to know if a company's Head Office in Delhi has its own defined working hours, overtime, holidays, leave, etc. (company's HR manual matching with laws and industry trends), do we still need to apply for registration?

Is the Act still in abeyance? If yes, how to confirm the same to meet the compliance requirements.

Yes, you need to register your establishment under the Act. Your policies regarding working hours, overtime, holidays, leave, etc., should not be inconsistent with the Act. Since the November 2009 notification from the Delhi Govt, it is now mandatory to register your establishment under the Act and comply with its provisions.

In which section should a written copy of amendments since November 2009 be kept for registration under Shops & Establishments? It is a must. Please help me.

I have a query. If we register our shop name in Delhi, and any other person can also register the same name for their shop, is it acceptable for two different proprietors to have the same name? Waiting for a reply.
