Resignation Notice: Can Employees Still Use Benefits During Their Notice Period?

One of our middle-level employees submitted his advance notice for resignation. He has served a 90-day (3 months) notice. I would like to know, when a person is under the notice period, can he avail benefits such as Leave Travel Allowance, etc.

Please let me know if you need any further information.

In our company, once a person submits their resignation letter, all their benefits are placed on hold and paid out to them in their full and final settlement. Is it right for us to handle it this way?

According to my view, "This will depend on the company policies." Some companies consider the views of Mr. Vinod Bidwaik and some of S. Karthik's. But the fact is that company policies can be changed under circumstances, and the benefit of leave, TA, etc. is under the authority of a company's policy.

Yes, Niku, you are very much right. Paying benefits to the employee during their notice period varies from company to company, and it purely depends on the policies of that company. I have seen a company where it only pays salary in the notice period, but not the incentives that the employee earns in their last month. At the same time, there are other companies that pay incentives along with the employee's salary at the time of the final settlement with the company. So, it purely depends on the company's policies and nothing else.

If anyone knows about anything mentioned specifically on this in Business Law, please do let us know. Actually, this has been one of my doubts for a long time.

Thank you very much for the valuable comments on the topic. From the views expressed by the members, I could conclude that benefits which are due as of the date of quitting can be extended, while other benefits that are time-dependent should not be given.
