Can ESI Officers Inspect Sub Codes After Main Code Inspection? Seeking Clarity!

Tara Prasad
Dear All,

I have a query, kindly solve it!

We have already been inspected by an ESI Officer, all the papers have been presented, and the inspection has been done as per the ESI rules on our Main ESI CODE a month before. But a day before, another ESI officer came to our head office in Delhi where we have our Sub Code, without any prior information and issued us a notice for the inspection. Is it true that even though the inspection has been done on the MAIN CODE, the inspector can inspect our SUB CODE as well? Kindly help me because as per me, once the inspection has been done on the MAIN CODE, there is no need to undergo inspection on the SUB CODE.

Hello Tara,

There is nothing in the ESI Act which disables an ESI Inspector from visiting your premises, be it a code or sub-code center. The veracity of any statement or information furnished can be verified by them as per the law. Unless motives are attached, which is very difficult to prove, exceptions cannot be made to such unwelcome visits. Bear with them and find a way out to tackle them.

Thanks,

Thank you, Mr. Nair. I am working on that, and I have prepared and scrutinized all the papers. I am ready for the inspection. However, it is also a fact that because of some uncertainty in our law, there always remains a dilemma.

Although, thank you very much.

Tara,

ESIC inspection of the main code does not exempt the branch office sub-code inspection. You don't have to worry at all. Just arrange the MSC-01 monthly returns, Form 5 monthly returns, Form 7, wage register, and muster roll. Importantly, the production of books of accounts can be avoided by submitting a letter to the concerned inspector stating that the books of accounts will be produced to the department from the Head office.

Regarding the books of accounts and Profit and Loss, any ESIC inspection should be straightforward, I suppose.

Thanks and regards,
