Feeling Trapped in a Job Beyond My Expertise: How Can I Resign During Probation Without Penalty?

I recently joined a construction company as a Manager. The appointment letter says I will be on probation for 9 months. No exit procedures or notice period are mentioned in the appointment letter for the probation period or for the subsequent confirmed service period. I have signed a Service Bond on a stamped paper which states that I will serve the company for 3 years, failing which I have to pay the company the salary for the remaining period towards damages (No training or training-related expenses are incurred or mentioned in the Bond).

During the interview with the CEO, as well as in my application and resume submitted to the company, I had clearly mentioned my fields of expertise. However, after joining the duty, I have been orally entrusted with responsibilities for all the sectors in which the company operates. These sectors, though related to civil engineering, bear no relation to my previously acquired experience.

I am extremely disturbed as I am unable to handle the sectors in which I have no experience because my responsibilities include very sensitive issues like Bidding. I am spending sleepless nights.

The management is not understanding the gravity of the situation and is insisting (orally) that I should shoulder the responsibilities as they have no other arrangement. I want to leave the organization. I have spent only about 2 weeks and to date haven't received any payment for my services. I have totally lost my peace and I want to get relieved of this mess at any cost. Please advise me on what would be the easiest way to leave the organization. Is it possible for me to claim my unpaid dues?

As far as your leaving the organization is concerned, you can leave the organization by informing them with a 24-hour notice as you are in the Probation Period. You can inform them by way of Registered Post.

Hello,

The process of searching for this job and joining would have consumed at least three to six months of your life. And you feel within a few days that the job is not to your liking. Please introspect, discuss with your close friends, discuss with your employers, give it a try, and wait at least one to two months.

Unless there is something unethical involved in the business, you should give it a try for one or two months. Then take a decision. You won't repent later.

I think Siva is absolutely right in your case. There cannot be an organization that assigns an irrelevant job/task to a professional employee. If this company has good professional management, then they will definitely understand and realize the unethical practices going on in the organization and implement the corrective actions. So, while you have a chance to resign within the probationary period, you can give this job a chance to continue and try to accommodate in the same position for a further 1 to 2 months. Later, if the circumstances are too difficult to handle, then resignation within the probationary period is the only solution.

NOTE: Because the company has given you a 9-month probationary period, you can resign on any date with a 24-hour notice within this period.
