Are Our Leave Policies Meeting Legal Requirements for Privilege, Sick, and Casual Leave?

Hi Guys,

Is there any particular number of privilege, sick, and casual leave that must be given to every employee by law? As of now, my company has:
- 15 Privilege
- 5 Sick
- 5 Casual

Dear Vartica,

As per the Shops & Estt. Act, it is mandatory to provide 21 calendar days of PL to employees. However, the act is silent on CL and SL. Our company has PL defined, but CL and SL are flexible.

As per the Shops Act, there is a mention of SL for 12 days and PL for 1 day for every 20 man days worked. If it is leave for field staff, PL is calculated at 11 days instead of 20.

As per the Shops Act, you can give CL/SL for 12 days as per your convenience, and PL can be given at the rate of 1 day for every 20 days; otherwise, it is as per your company policy to give more days. However, it is mandatory to give CL/SL & PL as per the law.

In our company, we have a practice of PL-21, SL-7, CL-7, and Regional public holidays -10.

Dear Janavi,

You are correct. As per Act SL & CL, it is 7-7 each, and PL/EL is 1 on each 20 working days after completion of 240 days.

Hi,

I work in an IT publishing (private limited) company in Mumbai, which comprises around 50 staff, and it is a UK-based firm. We do not work on Saturday and Sunday and have 10 public holidays in a year, taking into account Indian festivals, public holidays, etc. Currently, the company holiday policy states that employees can take 20 leaves a year, and if he/she takes more than that, the salary is deducted accordingly. There is no breakup of PL, SL, CL, etc., in these 20 leaves.

Can someone please advise on the way holidays should be split into different types like PL, SL, CL, etc., and also how many holidays should be there in all for employees in a year for a company of our size and nature?

Hi Dipali,

As per the Labour Act, everyone is entitled to 7 days of SL (Sick Leave) and 7 days of CL (Casual Leave) in a year, and 1 EL (Earned Leave) for every 20 working days after the probation period or after 240 days of joining.

Leave Policy in A.P

As per Section 30(1), every employee who has served for a period of two hundred and forty days or more during a continuous period of twelve months in any establishment shall be entitled, during the subsequent period of twelve months, to leave with wages for a period of fifteen days. It is important to note that such leave with wages may be accumulated up to a maximum period of sixty days.

Furthermore, Section 4 states that every employee who has served for a period of not less than two hundred and forty days during a continuous period of twelve months in any establishment shall be entitled to encashment of eight days of leave with wages that has accrued to him under subsection (1) during the subsequent period of twelve months.

In addition to the above provisions, every employee is entitled to CL-12 days, SL-12 days, and 9 National and Festival holidays.

Please be reminded that leaves are employees' rights, and we are required to adhere to the minimum rules as per APSE Rules.
