Terminated Without a Letter or Last Pay: What Are My Rights and Next Steps?

I was terminated by my previous employer. However, they are holding my last month's salary and I also didn't receive a termination letter from my company. Can you please brief me about the termination procedure from both the employee and employer sides?

You are required to check your appointment letter for the termination clause and then decide on your course of action. Normally, when there is termination, the employer pays for the one-month notice period, and when the staff resigns, it is vice versa. Hopefully, this solves your query.

Dear All,

In my offer letter, it was stated that upon termination, the concerned employee would receive either one month's salary or a one-month notice period. However, I did not receive either the notice period or the salary. Should I take legal action against my company to claim these benefits?

Please advise me on this matter.

Check with them for the termination letter. Only then would you be able to prove your point. You will need to fight for it.

As per your appointment order, it states about one month's pay or a notice period. Do check your manual too. See if there are any more clauses. The reason for termination should be mentioned. Above all, no company can terminate by word of mouth; a written document must be issued with the reason mentioned. Seek legal advice and then proceed.

Dear Sender,

If your appointment letter states that you will be paid one month's salary or will be given one month's notice, then the employer must have done either one. However, please note that the reason for your termination has not been mentioned. Unless a termination letter is issued, you cannot sue your company. You can send a formal registered letter to your company seeking the salary and a relieving letter.

Dear All,

I was terminated from the company for what I believe were trivial reasons. My question is, if I join an MNC and undergo third-party verification, what will HR say about me? Will they confirm that I worked at that company and had good conduct, or will they disclose that I was terminated, etc.?

Even I was also terminated from IBM Global Service in Bangalore due to being absent for a long time. Now, I need to know if I ask for a Service Certificate, will they provide it? Even in my offer and warning letters, they didn't indicate that once the employee is terminated, they will not be entitled to experience and a relieving order. However, I will not contest the termination because it was my mistake not to inform them of my leave. I want to pursue an Executive MBA where they might ask for the submission of the experience/Service Certificate.
