Gratuity Eligibility: Does 4 Years and 11 Months of Service Qualify?

Dear All,

Can anybody tell me whether an employee who has completed 4 years, 11 months, and 15 days is eligible for gratuity under the Payment of Gratuity Act? He has accrued 264 days of continuous service during this period.

As per the present amendment of the law, the employee is eligible for gratuity.

Hi,

The minimum period is 5 years of continuous services. Even a day less, eligibility for gratuity does not arise. In case the Shops and Establishments Act is applicable in your state, please check. In Andhra Pradesh, if a person works for 1 year, they are eligible for service compensation. The calculation is one and the same for both.

Dear Member,

If an employee completed 4 years plus 240 days of continuous service, he is automatically eligible for gratuity under the Gratuity Act.
