Is it Legally Correct to Deposit Provident Fund in Gurgaon, Haryana for a Company Located in Bhiwadi, Rajasthan?

Ajay yadav rewari
Our company is based in Bhiwadi, Rajasthan, but we deposit the Provident Fund (PF) in Gurgaon, Haryana. Is this practice in line with the PF Act?

The Provident Fund (PF) is a federal matter in India, governed by the Employees' Provident Fund Organisation (EPFO). The EPFO has jurisdiction all over India and is not confined to the state boundaries. Therefore, the location of the PF deposit does not necessarily have to be in the same state as the company's location.

However, it's important to ensure that the PF deposits are being made in an authorized branch of the EPFO. You can verify this by checking the details on the official EPFO website https://www.epfindia.gov.in.

If your company is depositing the PF in an authorized branch, irrespective of the state, it is in compliance with the PF Act. However, if you still have doubts or concerns, you should consult with a labor law expert or the local EPFO office for clarification.

HI Ajay

EPF is central Act and EPF permits to have one single account across India and contribute in one location.

The office (EPFO;s Sub Regional Office) has relevance only when you have to attend an enquiry (under sections 7A, 7Q, 14B etc). If you have an office in Gurgaon, it is easy for your person to attend the enquiry etc. But without an office in Gurgaon how did you get your PF attached to EPFO's Sub Regional Office in Gurgaon? That is not possible, hence it is understood that you have your office (mostly the head office) in Gurgaon. Then it is not at all an issue.
