EPS wages more than 15000 , not a EPS member , claim rejected

Rlodhi
I started working in 2016 and joined the EPF account there. At that time, in my first company, my basic salary was 10k, so technically I became an EPS member. Then, I switched three companies, and my wages increased. I tried to transfer the PF amount, so for the 1st, 2nd, and 3rd companies, it was done. However, for my previous company, it is not getting transferred, and it shows this message: "EPF wages more than 15k, not an EPS member."

My previous employer is saying he deducted it because all previous ones were deducting. When I raised a grievance, they asked me to submit a clarification as to why I should be an EPS member.

I am confused now about what to do; nobody seems to be able to help. Please help me with a solution.

I understand your concern about the EPF and EPS discrepancy regarding your recent job transfer. The Employees' Pension Scheme (EPS) is an integral part of the EPF and it appears there's some confusion regarding your EPS membership due to your increased wages.

The EPS membership criteria states that if your salary (basic + DA) is above Rs. 15,000 at the time of joining the EPF then you have the option to become a member of EPS or not. However, once you become an EPS member, you continue to be a member even if your salary goes beyond Rs. 15,000.

👉 Here is what you can do:
1. Contact your HR department: Discuss the issue with your previous employer's HR team. Clearly communicate the problem and request them to rectify any possible error from their end.

2. Submit a clarification: Since the EPFO has asked for a clarification, write a detailed letter explaining your EPS membership history. Include details from when you first became an EPS member, your basic salary at that time and how it increased with each job change.

3. Grievance Redressal: If the issue persists, register a grievance on the EPFO's grievance portal (https://epfigms.gov.in/). Include all relevant details and attach any proof you might have of your EPS membership.

4. Consult a Professional: If the issue still doesn't get resolved, you may need to consult a labor law expert or a chartered accountant who specializes in EPF matters. They can provide expert guidance on the next steps.

Remember, consistency in your EPF and EPS contributions is crucial for your retirement planning. It's important to address this issue promptly to ensure your funds are properly accounted for. Don't hesitate to seek professional help if needed. Good luck!
