Filing NIL Maternity Act: Is It Necessary Without Female Employees in Your Company?

Hello all, if there are no female employees in the organization, do we still need to file the NIL maternity act? Please share the form or link.

Maternity Benefit Act Applicability

The Maternity Benefit Act does not apply to self-employed women and those working with a firm that has fewer than 10 employees.

Eligibility for Maternity Leave

In order to be eligible for maternity leave in a company, a woman must have worked for a minimum of 160 days in the period of 12 months before her expected date of childbirth.

It's always good to submit the same in advance so that you don't need to rush later if the need arises. It's just a simple process of filing an application, which your CA can help with. If your company comes under the purview of the said Act, it is mandatory to submit a Nil return to the ILO or the local authority.
