Can My Company Extend My Notice Period Without Officially Confirming My Probation Approval?

I'm currently in a 6-month probation period, as stated in my appointment letter:

"During the probationary period, if applicable, the service may be terminated by either party on giving thirty days' notice or home base salary, at the discretion of the company. After satisfactory completion of the probationary period or in cases of immediate confirmation, the service may be terminated by either party on giving three months' notice or equivalent home base salary at the discretion of the company."

I recently got a new opportunity and informed my reporting manager of my resignation. During a retention call with my senior manager and director, my senior manager mentioned that my probation had already been approved, though I haven’t received any official confirmation from HR or my manager.

After the call, I sent an email formally resigning and stated I would serve 30 days' notice as per my appointment letter. Can they extend my notice period by claiming my probation is approved without official communication? My new employer has aligned my joining date based on the 30-day notice period.

I would recommend seeking immediate written clarification from your current employer regarding your probation status and applicable notice period. If no formal confirmation of probation completion exists, adhere to the terms outlined in your appointment letter, which specify a 30-day notice period during probation. Document all communication and remain professional throughout the process.
