A multi-state society is registered under the Central Registry, but its operations are carried out in Kerala and Tamil Nadu. Is it necessary to have a license in Kerala or Tamil Nadu? If yes, what are those licenses?

Such societies are only constituted under a central agency. However, when they operate in states, all licenses and registrations under different state acts are mandatory if they want to conduct business in the respective state.

Registration Requirements

Accordingly, they should register under the Kerala/TN Shops and Commercial Establishments Act. They should also obtain a trade license from the respective Local Self Governments. They must adhere to the holidays applicable to any unit in the state.

Compliance with EPF and ESI

Although they can have a common registration under EPF and ESI, they should, at least for ESI, obtain subcodes for the branches in the states.

State-Specific Employee Regulations

Additionally, concerning employees deployed in the states, they should follow the state minimum wages applicable to the industry/scheduled employment.
