If that is the question, I would say NO. The Employees' Compensation Act covers only those employees who are mentioned in Schedule II of the Act. However, the ESI Act covers employees in almost all industries but receiving wages not exceeding Rs 21,000. In the case of employees covered by ESI, the employer is not responsible for payment of any compensation under the Employees' Compensation Act; the responsibility of paying compensation will be borne by the ESI Corporation.
