Is a Part-Time Retail Employee Eligible for Gratuity Based on Full-Time Salary?

Hi, please confirm whether there is any law for part-time employee gratuity amounts regarding retail industry employees. A part-time employee works 4 hours per day and receives a salary based on the minimum wages of Maharashtra. Is the employee eligible for gratuity based on the full-time basic salary or 50% of the full-time amount? The employee has completed 5 years of service.

The full-time employee's basic salary is 14,880/-.

Hi, yes, gratuity is applicable to part-time employees provided they have completed 5 years of continuous service. Please ensure the employer is covered under the Gratuity Act.

Gratuity Eligibility for Part-Time Employees

1. There is no distinction between full-time and part-time employment in the Gratuity Act. As long as they worked without a service break for 5 years, they will get gratuity.

2. Yes, they will get gratuity.

3. Gratuity will be paid on their salary (last drawn salary), so it will be on basic and DA from the last paycheck.

They are not getting paid the full 8 hours' salary; they are receiving a lower salary for working fewer hours. What would be the reason to take half of it off for gratuity? You will have to pay on their full wages.
