Hospitals and the Shops and Establishments Act

Hospitals come under the Shops and Establishments Act of the respective states. In Kerala, some relaxations are available to establishments that operate seven days a week, 24 hours each day. However, this does not mean that employees should be asked to work more than eight hours a day or 48 hours a week. Similarly, hospital employees are not exempt from the provisions related to the payment of overtime.

The Kerala High Court held that a hospital, even if it is involved only in charity work, comes within the definition of a 'Shop' under Section 2(15) of the Kerala Shops and Commercial Establishments Act, 1960.

Employee Leave and Overtime Eligibility

The employees of the hospital are eligible for one day of leave for every six days of working eight-hour shifts. Additionally, employees are entitled to double the rate of payment for any excess hours worked beyond the normal hours of duty.
