Can we conduct packing work in the basement under the Factory Act 1948? If yes, under which section/rules?

If the basement is marked for parking (normally it is), then you cannot extend the packing operation, which is also a part of the operations of the establishment, to the basement.

There is no specific provision in the Factory Act regarding where you conduct your manufacturing activity. However, there are provisions for adequate lighting, ventilation, and other welfare measures. If you meet these requirements in the basement area, you can undertake packing activities there.

Also, your factory's approved layout must provide for the use of the space for packing activities. The factory inspector and the Site Inspection Team from DISH may not approve of it.

You follow the approved factory layout plan. Mostly, basements are used either for storage of anti-inflammatory products, storing materials, or parking.

Application for Changes in Space Usage

It is mandatory to make an application for any changes in the usage of space for business activities. Upon receipt of the application from the factory, the factory inspector conducts an inspection before issuing an order regarding the usage of the basement for packaging work.
