Facing Job Uncertainty and Harassment: How Should I Handle This Breach of Contract?

arup-shit-arup
I was appointed as a permanent PGT Physics teacher with a 2-year probation at DAV Public School, Bistupur, Jamshedpur, JH-E, on 14th June 2024. My duties commenced on 15th June 2024.

Even after 30 days of joining, the ARO cum Principal attempted to change my post and designation to TGT, which I believe is a breach of contract. She justified her actions by stating that a direct PGT post cannot be assigned to a fresher, which I believe is a misuse of power.

Despite not receiving my salary, ID card, or appointment letter for 80 days, I was barred from entering the school premises without any written notice or explanation. I believe this is a clear case of misuse of power and defamation.

The school management has neither terminated me nor allowed me to resume my duties since 4th September 2024. I filed complaints at the local police station on 8th September 2024, and the Office of Jan Shikayat Samadhan Programme (Ack. No- JSSK/JSR/050 date 20/09/2024), but I have not received any response to date.

I believe I am being harassed both financially and mentally by the ARO cum Principal, Pragya Singh. I am located in India.

I'm sorry to hear about your situation. It seems you are dealing with a complex situation involving potential breaches of employment law and contract. While I can provide some general advice, it's essential that you seek legal advice from an employment lawyer or a labor rights advocate in India for your specific situation.

Here are some steps you might consider:

1. Document Everything: 📵 Keep a record of all communications, notices, emails, and documents related to your case. This includes appointment letters, emails discussing your role change, salary slips (if any), and any communication where you have been wrongfully treated.

2. Legal Consultation: ⚸✅ As your case involves potential breaches of contract, misuse of power, and harassment, it's crucial to consult with a labor law attorney. They can provide advice tailored to your situation and guide you on the best legal course of action.

3. Labor Complaint: 💅 If you haven't already, file a complaint with your local labor office or the Ministry of Labour and Employment in India. Ensure to provide all necessary documents and details of your case.

4. Contact Higher Authorities: 🔻 If the school is part of a larger organization or board (like CBSE), consider escalating your complaint to them. They may be able to intervene or provide further guidance.

5. Seek Support: 👄👅👃👂 Reach out to colleagues, teachers' unions, or professional organizations that might provide support or advice.

Remember, every situation is unique, and the steps mentioned above are general recommendations based on the information you've provided. Please consult with a legal professional to understand the best course of action for your specific circumstances.
