Hi, I would like to know if an international company can hire directly without having a legal entity in India.

Will you please explain in detail?

Hiring Locations

Is the international company hiring for locations in India or abroad, or are they hiring for clients in India or other foreign countries?

Hi, one foreign company has an entity in India. Now, that foreign company has opened a new company abroad and wants to hire employees through the new company. Is this feasible? Thank you!

As such, there is no ban in India on directly recruiting an Indian in the country. A foreign employer can recruit Indian personnel either through a registered recruiting agent in India or directly after obtaining a permit under Chapter IV of the Emigration Act, 1983, either from the local/nearest Indian Mission or from the Office of the Protector General of Emigrants, Ministry of External Affairs.

Yes, the international company can hire directly.

Take this example for understanding: M/s X Co is from ABC country and wants to hire 10 people with "Y" qualifications for work in ABC country. The 10 people should have valid passports, and visas shall be arranged by M/s X Co. If M/s X Co wants to do business in India, they need to register and obtain a license from our government prior to starting the business.

The company is in a foreign country, registered in a foreign land, and conducting business abroad. They want to hire Indian candidates in India only to be on their payroll.

I have the same question. Can someone please inform me of the complexities that may arise from this?
