Dear Sir,
I have been working with a leading lingerie company based in Delhi as an ASM for the last 10 years. For the past 4 years, the company has been mentally harsh. They stopped yearly increments and cited reasons for sales decline. Then they began using abusive language and abruptly sent a termination message via WhatsApp. This mental torture continued. On 1st February, I was driving a vehicle and met with an accident. They messaged me not to come to duty until further notice. I was admitted to the hospital with swelling in my chest, but thankfully, my life was saved by God. Due to this incident, the company owner refrained from sending such messages for a month. However, in March, he resumed using abusive language even after our sales targets were met. On 29th April, while I was in Amritsar for office work, he called me, bullied me, and threatened to fire me if the day's order was not received. I explained that we had covered 85% of our target market, but he abruptly ended the call.
Under immense mental pressure, I fainted in Amritsar Queen Road, and an elderly lady accidentally hit me with her car, injuring my left arm. The distributor in Amritsar took me to a nearby doctor to stop the bleeding and recommended seeking treatment for depression at the hospital. I informed HR about the accident. The next day, my arm swelling worsened, and I was rushed to Civil Hospital Amritsar, where I received medical treatment for my arm and depression. I informed HR and requested 5 days of leave. However, the next morning, the company owner terminated me, claiming my leave had impacted sales. After 10 years with the company, I am aware of my rights. I reached out to the government's human resources department and cc'd the company owner. After 13 days, the company owner rescinded my termination, reinstating me as an employee. However, I was restricted from marketing activities. They scheduled a meeting at the office for 20th May, but I had a scheduled depression session at the hospital on that day, which I promptly informed HR about.
On the same day, they blocked my username in the field assist software. To my surprise, five days later, I received a notice demanding recovery of damages for contacting the government department. I responded, refuting all allegations, and was subsequently called to the Delhi office for a meeting. During the meeting, they requested a hard copy of my medical records, which I provided and had HR sign on paper. Seven days later, I received a court notice. I seek your advice on what steps I can take.
Please advise accordingly.
