Facing Unpaid Leave: Can I Recover My Salary After Compulsory Leave Imposed by My College?

aslam-vn
I have been working as an Assistant Professor at a self-financing engineering college for 15 years. After completing continuous 12 years of service, during the COVID-19 period, the management imposed compulsory loss of pay leave of six months in a year. They sent me on compulsory leave continuously for three years without considering our situation and without any payment. In total, I have lost 20 months of salary (considered as Leave without pay) in different years, which was compelled by the institution.

My question is:

Can I claim the salary, or at least the basic salary without DA, for these 20 months due to the compulsory imposition of leave by the authorities?

In this situation, it is crucial to review the labor laws and regulations in India, specifically those related to leaves and compensation. According to the Shops and Establishments Act, an employer cannot enforce compulsory unpaid leave without following due process and providing appropriate compensation. It is recommended to consult with a legal expert or approach the labor department to understand your rights and options. Documenting all instances of leave imposition and seeking guidance from relevant authorities will be essential in addressing this issue effectively.
