Dear Leena,

Your inquiry regarding the applicability of Workmen's Compensation to an IT company under the Shop and Establishment Act is an important legal and compliance matter that deserves a thorough and well-considered response.

Understanding the Workmen's Compensation Act

The Workmen's Compensation Act is a critical piece of legislation that provides financial and medical benefits to employees who suffer from work-related injuries or illnesses. The Act's coverage extends to a wide range of industries, including those covered under the Shop and Establishment Act.

Applicability to IT Companies

In the case of an IT company, the applicability of the Workmen's Compensation Act would depend on several factors. Firstly, the nature of the IT company's operations and the specific tasks performed by its employees would need to be evaluated. If the IT company's activities fall under the definition of "shops" or "establishments" as outlined in the relevant state-level Shop and Establishment Act, then the Workmen's Compensation Act would likely apply.

Furthermore, the size and structure of the IT company may also play a role in determining its obligations under the Workmen's Compensation Act. Larger IT companies with a significant workforce may have a clearer legal requirement to provide Workmen's Compensation coverage, while smaller IT firms may face more ambiguity or potential exemptions.

Reviewing Legal Obligations

It is essential to closely review the specific provisions of the applicable state-level Shop and Establishment Act, as well as the Workmen's Compensation Act, to ascertain the precise legal obligations and requirements for your IT company.

The Employees' Compensation Act shall not apply to all employees in commercial establishments. It shall apply to all employees in factory-type establishments, but when it comes to shops and commercial establishments, only selected employees as described in Schedule II of the Act will be covered. Schedule II is attached for your perusal.

Madhu is right.

As per the current legislation, it is covered for the industries or the employees who are engaged in the scheduled industries, and the same is not applicable for the rest of the industries.

Hi Madhu.T.K and Jeevarathnam, Thank you for your prompt response and for sharing your thoughts. Here, we would like to confirm: In IT companies where elevators are used, if someone gets injured in the elevators, are we required to pay compensation?
Madhu.T.K
It is certainly a question of law. An elevator is equipment installed within an establishment. Any injury caused due to its malfunction should be treated as an accident while in connection with employment only. The employer who has installed the equipment is responsible to compensate for the loss caused to the employees. But that may not fall under the Employees' Compensation Act. Obviously, if the elevator is within a factory, mine, or dock, it will come under the scope of accidents under the Act. But when it is under a shop or commercial establishment, it will come under other compensation. The employer can claim compensation from the manufacturer of the elevator/equipment failure or malfunctioning of which has caused the accident. This is what I feel right now. But I will get back with more thoughts on the subject soon.
