Navigating Legal Concerns: Can We Ask a Pregnant Project Manager to Resign Due to Reduced Billing?

In my office, we need to ask one of our female project managers to resign due to project shrinkage and reduced billing. Her last performance review was conducted a few months ago, and it also did not meet the expected standards. However, she recently informed us of her pregnancy. Can we still discuss her separation, or will there be any legal complications?

Hi, how long has she been serving your company? If she is eligible for maternity leave, then it is not advisable to send her out at this point in time. She can legally challenge the decision of the management. It is strange that many employers review the performance of female employees once they disclose their pregnancy to management!

The performance review was done before she announced her pregnancy. More than the performance review, the main reason is reduced project billing on her main project, and she is very well aware of it. She has worked for more than one year, so yes, she is eligible for maternity leave.

Hi, terminating employment at this point in time is not recommended, and it would be illegal.

Hi, as rightly said by our colleagues, it is illegal to terminate her services at this juncture. Let her complete her maternity leave, and only then, based on the facts and records, you can politely ask her to leave. Otherwise, this becomes a serious issue.

Dear Sir/Madam,

You may request her to leave the organization to reduce billing, but you must guarantee that after her maternity leave is over, she may be accommodated back in the organization. This is only a mutual understanding between her and the organization. Otherwise, the suggestion given above is correct.
