Hi everyone! I want to understand the legal applicability of an employee who is exempted from the Employees' State Insurance Corporation (ESIC) Act. I am curious about the rate of compensation that will be paid to them in case of employment disability or death.

Applicability of the Employees' Compensation Act

It will depend on the rate as per the Employees' Compensation Act. If yours is a factory, then it will have a direct application to all employees, right from the MD to the casual worker. However, if yours is a shop or commercial establishment, then the compensation is payable only if the deceased employee comes under the schedule of the Act. Please refer to the Employees' Compensation Act for details.

Compensation Factors

The compensation will depend on the wages and the age factor. The maximum wage for a death case or permanent total disablement is Rs 15,000. The attachment shows the compensation factors corresponding to the age of the employee.
