Can Section 17B Apply When Compensation Is Given Instead of Reinstatement? Seeking Advice

A dismissed workman has been awarded two lakhs as compensation by the Labour Court instead of reinstatement. Management wants to challenge it before the High Court. Will 17B apply in this particular case where no reinstatement order has been passed?

Section 17B of the ID Act 1947 comes into play if and only if the order of reinstatement is not complied with during the pendency of appeal proceedings. Since there is no reinstatement, you need not comply with Section 17B in this case.
