Is It Fair to Have No Leave Policy? Seeking Advice for My Friend's Tough Work Situation

firozhr
Hi All, My friend asked me some questions about salary in the company, and I also didn't understand. For example, he told me that in a month, there are 4 Sunday holidays and 26 paid days out of 30 days. If an employee takes leave on any particular day, then the salary is deducted for that day. There is no casual leave, sick leave, or earned leave in that company. Designations are high, but there is no system in that company. As per my knowledge, there should be 6 casual leaves (CL) and 6 sick leaves (SL) every year. I told him to talk to the person who discussed this with the MD. His service in the company has been more than ten years, but he has not earned a leave (EL).

They are working as slaves. If you work, you will earn for the day; otherwise, you will lose the payout for that day. Can anyone help me or guide me so that my friend can come out of this situation? The salary will be credited on the 26th of the next month (i.e., January's salary will be received on February 26th).

As suggested by Lakshmi Narayan, your friend can find a better job. Otherwise, he should fight for his rights. There are laws enforced to protect employees in general from such exploitation and ensure better service conditions like wages, hours of work, leave with wages, etc. If anyone points fingers at the employer, that will be a message to him. Let him make profits, but making profits by exploiting employees cannot be permitted. There are law enforcement officers to take care of the rights of employees. You can seek their help whenever you need.

Legal Perspective on Employee Entitlements

If you are viewing it from a legal standpoint, leave and timely payment are entitlements for all employees, not just workers. Thus, there is an issue with the company engaging in illegal practices. Another problem is that he is not receiving his salary on time.

Possible Solutions

The question is, what can you do? Taking a legal route is expensive and counterproductive in terms of time commitment and may also affect future job prospects. Therefore, finding another job might be a better option. However, he will lose a month's salary as he will only be paid on the 26th of the following month. It is apparent that he will not receive last month's salary.
