Am I Eligible for Gratuity After Working Just Two Days Short of 5 Years?

I have completed my job in a private school for 4 years, 11 months, and 28 days, including a notice period. I joined on 03.11.2009, and my relieving date was 31.10.2014. I am asking for gratuity from the school, but they denied it because I was two days short of completing 5 years. I want to know if I am eligible for gratuity or not.

Hi, Yes, you are eligible for gratuity. But why this question now after a lapse of 9.3 years from your relieving date? Have you checked with the school about gratuity at the time of relieving in 2014?

Thank you, Sir, for your reply. At that time, I had asked, but they refused. They said I am not entitled to gratuity. Once again, I want to mention that I asked the school, but they are refusing once again.

Please send your Gratuity Claim Form to your employer by RPAD. Approach the applicable Assistant Labour Commissioner/Controlling Authority and submit your claim. Furthermore, you should also submit a Condonation Petition for the delay of 10 years, stating that your employer did not provide anything in writing rejecting your gratuity claim. By this time, you should have initiated action.
