Gratutiy Eligible for retirement case for less than 5years ?

Employee has completed the service for 3year 4 months due retirement. his eligible for gratuity?

No, gratuity is not connected with retirement but it is payable only if the employee has worked for five years.

Dear colleague,
Earlier practice was there if any employee worked for yrs are eligible for gratuity but after induction of new labor code every completed year (240dys) gratuity is payable to the employee.
Pl. follow new labour code and state rule of your state .

@Manohar where is it in the new labour code? I did not find it. The labour codes are just copy paste of the old Gratuity Act in relation to aspects of gratuity. Even the interpretations of High Courts of Kerala or Madras on 4 years and 240 days, is not addressed in the new Code.
