Dear Sir,
What is the Provision of Gratuity Payment Calculation in a Death Case?

Example:
One Employee at the age of 35 died due to natural death and his total service in the organization is 1 year, so my question is how many years of Gratuity is payable as per Act? Is it till retirement or a year of service?

If Gratuity Act is applicable to your Establishment, you are liable to Pay 1 Year Gratuity to the Employee who died while in Service..

Gratuity calculation remain same. From DOJ to till date of death Gratuity calculated. If your Establishment is having any link with any insurance company then it would be the liability of the insurance company to pay the Gratuity.
