Facing PF Overlap Issues After Job Switches: How Can I Resolve This for My New Role?

Ammuu
Hi all, I joined as a fresher in X-Company, and then after two months, I got a better opportunity, so I decided to move to Y company. I asked for immediate relieving, but they didn't accept it. Instead, they asked me to pay 60K. At that time, I wasn't financially stable, so I ignored it. As a fresher, I didn't have much knowledge about PF-related matters. Therefore, I moved to Y company by ignoring X company.

Now, after two years of working at Y company, they discovered that I had 2 months of overlapping in my PF history because company X closed my PF account after 2 months from the date of absence. I paid the 60K to X company, and they provided an overlapping service letter, which was not helpful even though I paid the amount. Consequently, company Y forced me to resign, and I complied as there was nothing else I could do. Now, I have been selected for Z company, but I am facing the same issue. They are asking about this overlapping situation, and I do not understand what to do. Can anybody please suggest a solution?

You may write to the PF Commissioner stating that employer X made a mistake, which has caused you problems both with your PF and in your career. You can utilize the grievance field available on the EPFO website. It is unfair that employers misuse this against employees, especially after collecting money from them.

How can an employer collect notice pay from an employee? Under which law is it stated that they should be paid notice pay?
