After one year of employment, the resource is now demanding EPF deduction. Can we proceed with the deduction?

Earlier, there was no EPF deduction for the resource. However, after one year of employment, the resource is now demanding EPF deduction. Can we proceed with the deduction?

Why was he not given PF when he joined? Obviously, his salary could be more than Rs 15000 and he should have declared in form 11 that he was not a member of EPF earlier. Then that form 11 should be the document to show that he is an excluded member. You should have considered this fact in structuring his salary also. Naturally, in a CTC structure, the employer's contribution to PF would be part of remuneration. When you start contributing the CTC will also change. Therefore, the decision should come from the management. If the management is ready to contribute, you can start contributing to PF from now, with a date of joining of today's date. For all PF matters, the date of joining will be the date from which his contributions are paid. This should be acceptable to the employee also and for that you should get a letter and an undertaking that he was not a member of PF, and he knows that by law he cannot become a member automatically but would like to be part of PF from now. Please note that he will become a member of PF but he cannot become a member of Pension Fund. That should also be communicated to him.
