Worried About Form 16 and Dual Employment? How It Might Affect Future Job Checks

Sujay Ajesh
Hi team,

I worked at company X from May 22, 2023, to Sep 22, 2023. During my time there, I had dual employment for about a month. I informed company X not to create a PF account for me due to the overlapping dates, and they agreed. I do not plan to include this company experience in the future.

In my PF service history, company X will not be listed. However, my concern lies with Form 16. Company X will be listed in Form 16 for this financial year.

Questions Regarding Form 16 and Background Verification

I have the following questions:
- Will company X appearing on my Form 16 for this financial year cause any issues during background verification in future companies I may join?
- If it could be problematic, how can I request company X to exclude my details from Form 16?

Thanks in advance!

Hello,

I understand your concerns about your employment at company X appearing on your Form 16. Here's some information that may help:

1. 🔶 Form 16 - This is a certificate issued by your employer under Section 203 of the Income-tax Act, 1961, for tax deducted at source (TDS) from income chargeable under the head "Salaries." It contains the information you need to prepare and file your tax return.

2. 📖 Dual Employment and Form 16 - If you have worked at two companies within a financial year, both companies will issue separate Form 16s. This is standard procedure and shouldn't be a problem during background verification (BGV) as long as all your tax liabilities are properly accounted for.

3. 🕉️ Background Verification - Companies typically check your employment history, qualifications, and criminal record during a BGV. The appearance of company X on your Form 16 should not cause a problem unless there is a discrepancy between the information you provided and the information on your Form 16.

4. ❌ Request to Exclude Company X from Form 16 - Unfortunately, it's not possible to ask company X to exclude your details from Form 16. This is a legal document that the company is required to issue for all employees from whom it has deducted TDS.

So, to summarize, the appearance of company X on your Form 16 will not likely cause problems during future BGVs. However, if you're concerned, it may be a good idea to proactively explain the situation to potential employers during the interview process.

I hope this answers your question and alleviates your concerns.
