Hi, can you please let us know when an employee can apply for miscarriage leave? I mean, at what number of weeks of pregnancy, if a termination happens, can an employee apply for miscarriage leave?

Hi Keerthana,

In case of miscarriage or medical termination of pregnancy, a worker is entitled to six weeks of paid maternity leave. Employees are also entitled to one additional month of paid leave in case of complications arising due to pregnancy, delivery, premature birth, miscarriage, medical termination, or a tubectomy operation (two weeks in this case).

In case of a miscarriage, a woman shall, on production of such proof as may be prescribed, be entitled to leave with wages at the rate of maternity benefit for a period of six weeks immediately following the day of her miscarriage.

An employee is entitled to six weeks of paid miscarriage leave under the Maternity Benefit (Amendment) Act 2017, immediately following the day of her miscarriage or, as the case may be, her medical termination of pregnancy. The HR will need a medical certificate from the doctor or the hospital stating that you have miscarried. It need not be submitted as proof to your immediate boss or reporting manager.
